Hi,
I am on H1 visa and my wife is on H4. Our son was born here last summer with multiple complications, a few of them were life threatening as well. He is recovering well from multiple surgeries but still has issues that require constant medical attention. It is possible that I might be laid off soon and while I am searching hard to find a new job, it is possible that I might have to leave the country to avoid being out of status. With my son's current health condition, my preference is to stay here for some more years till he is completely out of the woods. I wanted to get expert advice from lawyers/members of IV as to what my options are? Will writing to my local senator and asking for a visa that will allow me to stay here even if I lose my job, an option? If so what visa would that be? I have another daughter who is on H4 as well. If we have to convert to b1/b2, is it straightforward and once on b1/b2, can I convert to H1 if I get another job? Are there provisions for parents to get green card based on a sick US citizen child?
Any help in this regard is highly appreciated.

As per my attorney, NO it won't affect the GC process. However the Job description should remain same as in your Labor Certificate.
Better confirm with your attorney.

PD isn't current, but just check i-485 online status, showing "Document production or Oath Ceremony" (i.e., the last cycle).
There was indeed a soft LUD in June this year. After that nothing much else. Is there sth good coming along my way?
Appreciate if anyone here can share his/her thoughts/comments.
Don't rely on online status, take infopass and check it out. BTW, it is most likely a FP notice, not an approval.

As many regular readers of this blog know, I am impressed by the amazing work of Vivek Wadhwa, research associate at Harvard, and an entrepreneur in residence at Duke. This pieces and other recent pieces show that plodding ideas about commissions and study groups to recommend visa numbers are relics of a past age. The question is, will Congress act quickly enough on immigration reform to actually make a difference in helping our economy recover. Every immigration lawyer knows these simple truths--lazy people do not walk across the desert. And, its corollary--the Hope that is American attracts those willing to work hard to succeed. Well, the former principle is still true, at least for now. The latter is giving way to hopelessness--backlogged visa numbers ("encased in amber"), and a growing and vibrant economy in China and India. The failure to act quickly is going to cost America in the long run. Here (http://www.dphoto.us/forumphotos/showgallery.php?cat=1377) are a few pictures from my excursion to Turkey Run S P last weekend. While my camera performed better than I expected from a late-90's era 2.7MP DSLR, I didn't fare so well, coming home with far fewer "keepers" than I would have liked. My greatest problem was that I either didn't set up a tripod or failed to increase the ISO to get more DOF in many landscape shots that needed it, and frequently I also got motion blur from lack of tripod usage. This experience has taught me that for me personally, even though the D1 is 2 stops faster than Velvia, I still must slow down and use a tripod - not only to prevent blur and enable slower exposures, but also to force a slower and more thoughtful pace of composition.

Anyway that I can get a solid black line? It keeps preserving the opacity deficient coloring of the actual rectangle. More or less, the black line is getting the same 50% opacity as I made the rectangle. Don't want that. :P

for changing status from h1 to h4 u must file Change of status form on I539 - This can be downloaded from uscis.gov
You wld get into h4 status once u receive the new i94 from uscis showing h4 start and end dates.
If you travel , you must obtain a h4 visa stamp before re-entry to get back into h4 status

there is another LUD on my 485 today, continuosly from the last 4 working days Dec6th,7th,10th and today(11th)..not sure what's going on...:confused:
It could be anything. Did you get your biometrics taken recently? People normaly would get updates after that. The first meaningful update would be something like "On xxxxx we have ordered your (green) card production". If you got that, you know you got your green card. But your PD is late than current processing date, they wouldn't adjudicate your case, even your name check is cleared. Is your name check cleared?

Thanks a lot Dom, it took some time for me to find transparent layered maps of water to work with. Initially this was drawn with the orange falling down, but an even splash wasn't what i had in mind. So I had random splash, mostly one directional and then spinned the image to have gravity work as well-once again thanks

I am in NYC. My wife's attorney Stephen Perlitsh, is just too busy to give us some career guidance and cancels our appointments in last moment. I have no problem paying a good fee if I can get a real good prefessional advice, it is very essential for us in this retrogressed scenerio.

Infact I got a call from US Consulate and they said the same thing to me, and they offered to cancel the appointment for me.
I did get the appointment thru some agency and was wondering if they played a trick but the agency vehemently denied doing any such thing,
I had a Toronto appt as well.
However not sure if it was an official call or a prank
I have an appointment in Toronto next month and today I got a voice message from the US embassy in Canada saying that there could be processing delays of days or months and the decision will be taken by the visa office during the interview. Has anyone else got this kind of message?

I am also in the same scenario. Filing I-140 and I-485 concurrently. My company's immigration attorney said that while filing for I-140 and I-485 concurrently, we can have the I-140 done in premium processing. And that is how they are filing for me now

which help to get overtime for full time employee.
I know if you consultant you get paid by hours but not when you become full time employee.
Overtime is paid only if you are a non-exempt employee - usually means you get paid hourly. If you are an exempt employee, then you are not eligible for overtime. Not sure if this is different in different states, but that is how it works in Ohio.

Check with the prevailing wage for your new location that matches your job title/description. It needs to be close to that.
The salary needs to be 'at' or 'above' the prevailing wage, not 'close' :)

I also have a similar case of 2 485s . I have EB2 priority date of September 2005 and not yet approved. May be multiple A # make it complex. I am planning to take an infopass apppointment and talk to IO and inform that we have 2 A#. Let us know how your appointment goes
