Those people who are all stuck in Labor certification.
1. What are the options going forward if our labors are not certified?.
2. What are the chances that BEC people are not able to meet their deadline (sep 30) in clearing LC?
3. Is there a justice and truth in life? Or everything depends only on time and luck?.
4. What if some of us get laid off.........our path ends?.
5. Is there something GOOD waiting for all of us?.
Waiting .......waiting...........waiting................wa iting sucks!.

Guru's please help with the following situation: Labor PD: Dec 2002, Labor approved Feb 2005, I-140 approved May 2005, Filed I-485 (because of retrogation) in May 2006 for both me and wife. Got EAD Dec 2006. Got laid off in Feb 2007 from sponsoring company and decided that I have had enough of US immigration waiting and returned to home country for good in April 2007. Changed address to friends US address for USCIS records just to make sure that any communication from USCIS does not get lost in the mail. Was sure that the employer will cancel the whole GC process. But to my suprise on April 21st 2008, received the automated email from USCIS that 485 has been approved. The I-797 approval notice of action was received at my friends US address with a note that the plastic card should arrive within 30 days. This was back in April-May 2008 time frame. Well the plastic card never arrived inspite of phone calls to USCIS to either cancel the 485 or send the card.
Can someone please educate me as to what I should do get the 485 cancelled and stop further processing of my wife's 485. I am afraid that I am stuck in a situation where the USCIS records indicate that I am a permanent resident when they never fully approved my case in time, while I have been out of the US for 2 years and do not intend to return. The US Consulate here has been of no help. Will this have any overhang for future US visits/immigration for me and my wife or for my children who are US Citizens.

Lawyers can usually justfy some minor spelling mistakes and answer to RFE. Usually USCIS accepts BC name.
Based on inputs from my lawyer, there is some delay if such descrepency is there - he said that he can reply to such RFE and apart from delay there is no other issue.

i'm finishing work on friday and i still havn't got a new job. I'm a really shy person and i hate the thought
Hey, just be confident.. not all people get a chance to go in a place and apply for a job.. besides, if you have all the qualities of an applicant, there is no reason to be shy, rather tell your interviewer on what you can do to be an asset and help the company grows more.:D

If the priority dates are not current for the category in which your parents are seeking a green card, then they will have to wait for the priority dates to become current before they can apply I-485. You can check the Visa Bulletin for more info.

I am planning on getting my H1 done for this year... i have talked to a couple of people about the same and someone said thai i might have Pay to get my H1 Processed and get the job.... is it a right choice to make....
most of the H1's consultant i have come across does only ITsector
is there anyone who can suggest how to get the H1 for other field like Pharmacy, Microbiology.....etc....
Most of the consultants ask you to pay for the H1's these days for security. Some will re-imburse your money after a period.
But according to the law, employers are supposed to pay for H1 and travelling expenses if you are in your home country.

What happened to their own plaintiffs - even couple of days back they
said that they more than sufficent plaintiffs...
Are you guys filling up PLAINTOFF form ? The problem is that AILA /AILF
is a blackbox ... You can see that they are exchanging emails but cant read the content of email... ONLY FOR MEMBERS :mad:

Not sure if this is the section to post this.
I am listing a few things that rake up my mind whenever I think of my prolonged (for me its prolonged though) stay in US. Dragging my feet over decisions to go back or not.
My posting is entirely my view. I would not be willing to trample on other's feelings. Just sharing a few things.
Cons
------
1) Leave everything behind as such in our native place and start everything afresh here. Looks cool for a start. But end up in a remote place with few people and no friends. Life starts to suck when you move on for some months in the remote place. Some like it most don't.
2) Trying to look back on what we missed being with family and friends, those good old days. Sitting on a wall/bench and chatting about daily happenings/cricket etc
3) Going back after some time to be bewildered on what happened to those buildings that were there. Before you digest all those, your vacation is gone. Poof
4) Most Importanty, live with fear on what will happen to those near and dear who have been wishing us good luck and health. Just imagining that fact that when you visit back next time, they might not be there, gives me sleepless nights. This is true even when you are back in your native place but at least you have a solace in seeing them whenever you require and help them in their times of need physically. Nothing is like what you do rather than telling others to do.
5) Missing all those religious events, happenings, special occasions.
Pros
-----
1) Live own life without any bindings (we can give umpteen excuses on how we are forced to live but its still our life)
2) Money factor
3) Move away from petty politics
4) Your own car.
5) Wifeys like it here as it moves them from home politics and they drive the home here.
These are my thoughts. Just sharing with a few who might care.

I just got my PERM approved and I am debating about next steps of my eb-3.
it looks now that with the current retrogression the process will take 5 years. the company I am working for is not very stable and probably will be sold in the next 24 months.
I can look for another company that will sponsor me, but even if I will find one I need to start all over again and that will throw me at least 1 year back (not to mention the money I already spent so far, which was a lot)
What do you think

My EAD, AP and II140 are all approved because of the July Fiasco and its been more than 180 days since they all got approved.
I have my EAD and AP in hand, but I140 is with employer. I neither have a copy of it, nor the receipt number/tracking for it . All I know is that it is approved. My employer will not give it to me as it is not required by law. I am still working on H1 (haven't used EAD yet)
Recently the client I am working with asked if I would be interested in a full time with them and said I can use my EAD. Is it possible for me to take up this offer without having any details about my I140 except knowing that it is approved.?
PS: I trust my employer. If they said my I140 is approved, then it is.

1) Does everyone get called for an interview or is it done on selected cases based on individual factors?
2) When is it generally done? Prior to approval of your 485 or prior to the issue of your visa(GC).
3) Why is it done and what kind of questions can one expect during the interview?

A couple acquaintances have gone through the process. Some Australians were given a lot of grief when the person accused them of coming from Antigua or some little Island. It was obviously a typo on their part--they have obvious Aussie accents. He accused them and accused them. They didn't give and the officer gave up. Officer 0, immigrants 1.
Another woman was asked if she's planning on staging a terrorist attack. (She's French.) She said something like "If I was, would I tell you?" and then had to wait an extra year as the officer said they were done. Officer 1, immigrants 0
Remember spouses birth dates, etc.
So even if they ask idiot questions, and they probably will, don't make any jokes or anything. Be firm, formal, and polite. Behave as you wish they would.

Sorry to hear that...a simple mistake will cause your wait to become longer. I hope your lawyer or company compensated you for all the expenses you incurred during that period. It was truly frustrating.
